Messuage or tenement with appurtenances in Loughborough, Leicestershire, called the Highgate, and two cottages or tenements with appurtenances in Baxtergate in Loughborough, and messuage or tenement with appurtenances in Loughborough in a place there called Sparrow Hill, and all those several pieces of arable land, lea ground, meadow, pasture and grass ground dispersed in the fields of Loughborough (¾ of a yard land) all of which belonged to Joseph Clarke before the marriage; and close in Burton on the Wolds called the Plaster Pitt or Stone Pitt Close (13a.); and close with appurtenances abutting upon Walton Brooke and called the Stone bridge Close in Burton on the Wolds, and 11a. arable land lying in the three fields of Loughborough, viz. 11 lands lying upon Burleigh Hill (4a.), nine lands and three head lands (3a.), two lands containing 1a., two lands and a sike (1a.) in the Middle Field, four lands (1a.), three lands containing by estimation 3r., one land (1r.), 1½a. and a filling of meadow in Long Asserdam, four leas upon the lings (1½a.); and also all those several pieces and parcels of arable land, meadow, and pasture dispersed in the fields of Loughborough (4a.) (details), all of which have been purchased by Joseph Clarke since his marriage, pursuant to the articles of agreement concerning the marriage.
To be held to the use of Joseph Clarke for term of his life, then to the use of 2. during the life of Joseph Clarke, in trust to preserve contingent remainders: after the death of Joseph Clarke, to the use of Frances his wife for her life, for her jointure; and after the death of Joseph and Frances, to the use of the heirs of Joseph by Frances; for default of such issue, to the use of the right heirs of Joseph Clarke for ever. But if there are two sons only, or one son and a daughter, then the messuage or tenement which were Joseph Clarke's before the marriage, and a third of the closes purchased by him since his marriage, to the use of the first son of Joseph Clarke by Frances and the heirs of his body; and the two other third parts of the property purchased since the marriage, to the use of such second son or daughter and their heirs.
