Recites that Sir Daniel Deligne, father of 1., in consideration of the marriage between Erasmus Deligne and Penelope Archer, daughter of Sir Simon Archer, by his deed of 6 Oct 1651 settled the manors of Bruce Fee, Swinford Fee and Mackender Fee alias Hall Fee in Harlaxton, the land called the Sixteen Acres containing 145a., Havercrofts, Woodcocke Wong, little Westmore, little Eastmore, the great Holme Close, the three and twenty acres in the Marsh, the Seven Acres in the Marsh, the Close of six and twenty acres adjoining to Barrowby Hedge and gate, the close of 13a. lying under Pease Hill, the Pease Hill Close, the Hornibush Close, the Close adjoining William Brigg, the close called Stackthorne Thurndall Hill Close and the several messuages and holmes closes in the possessions of John Right and John Stephenson to the following uses: To the use of himself and his heirs until the marriage, then to the use of Erasmus for life, remainder to Penelope for her jointure, with other remainders over.
And the two great More Closes, Sunnybanks Close, the close under the [ ] Hill, and Broadley Close, to the use of Sir Daniel and his heirs until the marriage, then to Sir Daniel for life, with remainder to Erasmus for life, with other remainders over.
And the capital messuage and all other property, to the use of Sir Daniel and his heirs until the marriage, then to the use of Sir Daniel for life, remainder to Dame Elizabeth for life, remainder to Erasmus for life, with remainders to the sons of Erasmus by Penelope successively, with other remainders over.
3. is the only male issue now living of Erasmus and Penelope, and there have been of late several suits in law and equity between the parties concerning the felling of timber and committing of waste on the premises. Recites that, for composing their differences, the parties did on 2 Nov pursuant to a degree in Chancery, whereby Erasmus agreed to be absolutely foreclosed from committing any waste on the premises during his life, agree that Erasmus should give liberty to Dame Elizabeth and Daniel to sell or dispose to their own uses all such timber, woods, and underwoods growing on the premises as they should think fit.
Now therefore, in pursuance of the decree, 1. releases and quit claims to 3. and his heirs all benefit and advantage that he may have by virtue of the words "without impeachment of waste" in the said settlement, and covenants that he will not commit any waste.
