Quotes surrender, 1-PG/3/2/3/3.
Recites that after Ann Orton had attained the age of twenty-one years, Charles Neville exhibited a bill in Chancery against Dorothy Glynne, Ann Orton, Thomas Burrell, Titus West, and John Joans to compel Ann Orton to perform and execute such parts of the said surrender which he had covenanted she should perform and to procure him to be utterly released there-from. It was ordered that it should be referred to one of the Masters in Chancery to see which of the covenants in the deed of 25 May, 1733, remained to be performed by the complainant, and that Ann Orton was to enter into like covenants and indemnify the plaintiff. The Master was also to compute interest at 4 per cent for the £700 which Ann Orton was to pay, with interest, to the defendent West, and the residue of the £1,000 to Dorothy Glynne.
2. and 3., in obedience to the said decree, surrender, grant and confirm to 1. all the premises as in 1-PG/3/2/3/3 and all the estate of 2. and 3. in them, on condition that 1. shall yearly during the life of 2., out of the rents and issues of the premises, pay 2. £250 (as provided in the indenture of 25 May 1733). Distraint in case of arrears.
2. and 3. give and grant to 1. all 2.'s goods and household stuff, all chattels and all sums owing to her by tenants at Lady Day 1733, in trust to discharge the debts due from Dorothy Glynne at the time of the indenture of 25 May 1733 to the persons named in the schedule annexed to it and all other her debts up to that date (with certain exceptions), and with the residue to discharge debts owing by Cadwallader Glynne on mortgage or other specialities.
2. appoints 1. to demand and receive all such sums as are owing by any persons in the said first schedule and by the tenants of the houses in parish of St Botolph's, London.
1. covenants that she will pay the debts mentioned in the second schedule and keep 2. indemnified.
