To be held by (4) from the marriage, in trust that (2) may during the joint lives of (1) enjoy an annual sum or yearly rent charge of £700 to be issuing out of all the property. And that Teresa Constable Maxwell, if she shall survive (2), may receive a yearly rent charge of £600 for the term of her life in life in part of her jointure.
The property to be held by (4) for 300 years from the marriage on trust. And from the determination of that term to the use of Eleanora, Lady Clifford, and her assigns for the term of her life; from her death, to the use of Charles, Lord Clifford, for the term of his life; and from the decease of Lord and Lady Clifford, to the use of (2), for the term of his life. And from the determination of the estates limited to Eleanora, Lady Clifford, Charles, Lord Clifford, and Charles Thomas Clifford in their respective lifetimes, to the use of (4) for the life of such of them whose estate shall so end, in trust to preserve contingent uses. And from the decease of the survivor of Eleanora, Lady Clifford, Charles, Lord Clifford, and Charles Thomas Clifford, to the use of the first son of Charles Thomas Clifford by Teresa Constable Maxwell and his heirs male; for default of such, to the use of the second and other sons of the marriage successively and their heirs male; and for default of such issue, to such uses as (1) or the survivor of them shall appoint. For default of such appointment, to the use of the first and other sons successively of Charles Thomas Clifford by any other wife; for default of such, to the use of the sons of Charles, Lord Clifford, by Eleanora, Lady Clifford; for want of such appointment, to the use of Hugh Charles Clifford for his life; and from the determination of that estate in his lifetime, to the use of (4) during his life on trust to preserve the contingent estates; and from the death of Hugh Charles Clifford, to the use of his first and other sons successively and their heirs male; for default of such, to the use of the Hon. Edward Clifford, third son of (1), for his life, then to trustees to preserve contingent uses; from the death of Edward, to the use of his first and other sons successively and their heirs male; for default of such, to the use of the Hon. Walter Clifford, fourth son of (1) (as before); for default of his sons and their issue, to the use of the Hon. Robert Clifford, fifth son of (1), as before; for default of such, to the use of all other the sons of Charles, Lord Clifford, successively.
The term of 300 years is on trust in the first place for better securing to (2) during the joint lives of (1), the payment of the yearly rent charge of £700; and in case Teresa shall survive him, for better securing to her the yearly rent charge of £600. And on trust that if (2) shall die in the lifetime of (1), leaving any male issue by Teresa who shall be entitled to the property on the decease of the survivor of (1), then (5) shall levy the yearly sum of £100 and use it for the maintenance and education of such eldest or only son. After the deaths of (1) and (2) and failure of his male issue, (5) shall raise and pay to Edward, Walter, and Robert Clifford, the three youngest sons of (1), or such of them as shall be then living "and not for the time being be engaged in any religious or ecclesiastical state of life", the annual sum of £200 for their lives. And upon further trust they shall allow the person who for the time being shall be entitled to the remainder and reversion of the premises expectant on the determination of the term of 300 years to take the residue of the rents and profits.
Further provisions.
Agreed that when and so often as the sum of £12000, part of the fortune of Teresa Constable Maxwell, the interest of which is to be paid to her by the trustees in case she survives Charles Thomas Clifford, as part of her jointure, shall not produce an annual interest or income of £600 upon whatever security it is invested, then the deficiency shall be a charge upon the same and shall be raised by her and the trustees out of the term of 300 years, and be paid to her.
The property is subject to a mortgage debt of £6000 and interest to Sir Thomas Whichcote and another of £4000 and interest to John Fardell. Therefore (1) appoint that the property appointed, granted and released shall in respect to all persons claiming title to the estate be exonerated and discharged from the mortgage debts, and that the other hereditaments shall keep harmless and in dignified the property here appointed, granted, and released.
